The website freshfonts.io and its sub-domains, as well as its products and services, are run by Noemi Stauffer (Fresh Fonts) an individually owned business registered in Switzerland with company registration number (IDE) CHE-445.998.059.

By accessing our website, signing up for our newsletter, or becoming a member, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

Although Fresh Fonts is based in Switzerland, its products are billed in USD for convenience. Note that it is currently not possible to pay for the Membership in any other currency. This doesn’t apply to our custom font services, for which we are happy to bill clients in their preferred currency.

Fresh Fonts annual turnover do not meet the legal threshold to perceive sales tax. Therefore, all sales are exempted from taxes.

These terms of service are governed by the Swiss law, without regard to conflict of laws provisions.

Our websites and emails may contain links to third party websites or services that are not owned or controlled by Fresh Fonts. Fresh Fonts has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party websites or services.

Fresh Fonts sends a free, monthly newsletter featuring a curated selection of new font releases from various different owners and designers. By signing up for the newsletter, you are agreeing to be bound by these terms.

The free version of the newsletter is sent once a month, usually on the third Tuesday of the month. That said, the publication schedule of the newsletter can vary according to content availability. Note that we may pause or discontinue the publication of the newsletter at any time without prior notice.

Fresh Fonts publishes various images of typefaces (font designs) on its website and in its newsletters. These designs are protected by copyright, trademark, and other laws of both the United States and foreign countries. All the typefaces shared on our website and in our newsletter, including their images, belong to their respective owners and not to Fresh Fonts, unless stated otherwise.

If you no longer want to receive the newsletter, you can simply unsubscribe by clicking the “unsubscribe“ link at the bottom of any email.

Fresh Fonts provides a subscription service that allows members to download a font family every month, and receive additional member-exclusive content by email. By becoming a member, you are agreeing to be bound by these terms.

The Fresh Fonts membership is cardless. The key identifier is your email address. The membership is personal and you cannot transfer it to another person.

Your Fresh Fonts membership will continue until terminated. To use your membership, you must have access to emails and provide us with one or more payment methods. “Payment method” means a current, valid, accepted method of payment, as may be updated from time to time. Unless you cancel your membership before your billing date, you authorize us to charge the membership fee for the next billing cycle to your payment method (see “Cancellation” below).

The member who created the Fresh Fonts account and whose payment method is charged is responsible for any activity that occurs through the Fresh Fonts account. To maintain control over the account and to prevent anyone from accessing the account, the member should maintain control over the email address that is used to access the service and not reveal the password or details of the payment method associated with the account to anyone. You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. Members receive the paid version of the newsletter. As opposed to the free version of the newsletter, that is sent once a month, members receive two issues of the newsletter every month — usually on the first and third Tuesday of the month. That said, the publication schedule of the newsletter can vary according to content availability.

As part of their member benefits, members receive a license to use a font family every month (“the font family of the month”). Links to download such font families are provided in the paid issues of the newsletter that member receive. For safety reasons, and to restrict illegal downloads of these font families, these download links expire at a given time mentioned in the newsletter. If you miss a download link and it is now expired, you can still redeem the font files of these font families by reaching out to support@freshfonts.io.

Members are only eligible to download the font families of the month offered during the months that their membership is active, and that their monthly membership fee is paid in full. By downloading the fonts, members accept the terms of the End User License Agreement (EULA) of the corresponding type foundry, which is provided together with the font files. By downloading the fonts, members also agree to respect the usage included in the font license, as stated in the newsletter and/or in the EULA file provided together with the font files. Because the license is perpetual, members can keep using the font files even after they cancel their Fresh Fonts membership, as long as they respect the usage included in the font license. Sharing the font files with other parties, or redistributing them, is striclty prohibited. Fresh Fonts reserves the right to void a font license offered to a member if we suspect any form of abuse or license infringement.

The font families of the month offered to members remain the exclusive property of their respective owners. Fresh Fonts solely acts as a distributor between the corresponding type foundry and Fresh Fonts members. Therefore, when downloading the fonts, the Fresh Fonts member (the “end user of the font software”) enters a legal agreement (an “End User License Agreement“ or EULA) with the corresponding type foundry.

The membership fee for the Fresh Fonts membership and any other charges you may incur in connection with your membership fee, such as taxes and possible transaction fees, will be charged to your payment method on a specific day of the month, which is determined by the day of the first payment date. The length of your billing cycle will depend on the type of subscription that you choose when you signed up for the membership. In some cases your payment date may change, for example if your payment method has not successfully settled, or if you change your subscription plan. You can see your next payment date on the customer portal provided by Stripe, which you can access through your account.

To become a Fresh Fonts member, you must provide one valid payment method. You authorize us to charge your primary payment method, or any payment method associated to your account, in case your primary payment method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, your account will be cancelled. Note that for some payment methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your payment method.

You can update your payment method by going to your account page on our website. We may also update your payment method using the information that you provided to Stripe, our payment service providers. Following any update, you authorize us to continue to charge the applicable payment method.

We may change our subscription plans and the price of our membership from time to time; however, any price changes will apply no earlier than 30 days following an email notice sent to you.

We may from time to time offer free trials to our membership. You can cancel your free trial at any time, and you will continue to receive the paid version of the newsletter through the end of your free trial. To cancel your free trial, go to your account page on our website and follow the instructions to cancel your membership. If you cancel, your account will automatically close at the end of your free trial, and you will be downgraded to the free version of the newsletter. If you opted in for a free trial, our payment service provider, Stripe, will send you an email reminder seven days before your free trial ends. Unless you cancel your free trial before your first billing date, you authorize us to charge the membership fee for the next billing cycle to your payment method.

We may from time to time offer special promotional offers, plans or memberships. Offer eligibility is determined by Fresh Fonts at its sole discretion and we reserve the right to revoke an offer in the event that we determine you are not eligible.

If you need assistance with your account, please visit the Help Center on our website. If you require additional assistance, please email support@freshfonts.io. In the event of any conflict between these terms and conditions and the information provided on other portions of our website, these terms and conditions will control.

You can cancel your Fresh Fonts membership at any time, and you will continue to receive the premium version of the newsletter through the end of your billing period. To cancel, go to your account page and follow the instructions for cancellation. If you cancel your membership, your account will automatically close at the end of your current billing period, and you will be downgraded to the free version of the newsletter.

If there are any serious issues with the font files, reach out via support@freshfonts.io within 30 days and we’ll issue a full refund. Please note we cannot issue a refund if you simply change your mind after becoming a member, or decide not to use the font files. If we issue a refund, you agree to delete all font files within 24 hours and are not permitted to use them in any project (including personal/non-commercial projects). We reserve the right to determine if you are eligible for a refund or not.

If you wish to terminate your account, you may simply cancel your membership. To cancel, go to your account page and follow the instructions for cancellation. All provisions of these terms of service shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

We reserve the right to terminate your membership, remove your access, or revoke your font licenses without prior notice or liability, under our sole discretion. We may do this if we suspect any form of abuse or font license infringement.

Fresh Fonts services, including the newsletter and membership, are provided “as is” and without warranty or condition. In particular, our services may not be uninterrupted or error-free. You waive all special, indirect and consequential damages against us. These terms will not limit any non-waivable warranties or consumer protection rights that you may be entitled to under the mandatory laws of your country of residence.

We reserve the right, at our sole discretion, to modify or replace these terms of service at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our website and services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorised to use the website and our services.
